I. INTRODUCTION
- The Hopewell’s Landing community pool and pool house are owned by the Hopewell’s Landing Homeowners Association (HOA) and are operated and maintained each year by a professional pool management company under contract to the HOA. These rules are intended to ensure safe and sanitary operation of the pool, and the pool management company is directly responsible for enforcing these rules. Residents or their guests who violate rules are subject to expulsion by the pool company and revocation of pool privileges by the HOA Board of Directors. Your cooperation will afford pleasant relaxation and recreation for everyone using the pool and its facilities. Parents are requested to caution their children to observe all rules and obey instructions of pool management and employees. If there are any questions or concerns regarding these rules, please contact the community management company right away using the contact information on the cover page of these rules.
- These rules cover all pool and pool house grounds, cement deck surrounding the pool, and pool house which contains the bath/dressing areas and pool management area. These rules will be rigorously enforced.
- All persons using the pool or pool area do so at their own risk. The Association and management assume no responsibility for any accident or injury in connection with such use or for any loss or damage to personal property.
II. RIGHT TO USE THE POOL
- “Resident” is defined in Article I of the Hopewell’s Landing HOA Bylaws, “shall mean and refer to (i) each individual occupying any Dwelling Unit pursuant to a lease agreement with the Owner thereof who, if requested by the Board of Directors; (ii) members of the immediate family of such individual or of an Owner who actually resides within the Property and in the same place of inhabitation at a Dwelling Unit of any such individual or Owner to which, whenever he is absent, he has the intentions of returning.” Residents in good standing of the HOA have the right to full use of the community swimming pool.
- Residents, by virtue of their use of the community pool, agree to abide by these rules and regulations.
- The right of residents to use the pool shall be suspended during any period in which assessments against their lots remain unpaid. (Article II, Section 1(a), Declaration of Covenants, Conditions and Restrictions)
- Residents violating these rules, or any other rules of the Association, including but not limited to, Architectural Design and Maintenance Standards may have their right to use the pool suspended for a period not to exceed sixty (60) days.
- Pool Privileges are not transferable. Privileges will be assigned to the owner of the property within the Association. An owner shall have the right to assign his/her Hopewell’s Landing Pool Rules Page 3 of 7 privileges to the current resident if the owner does not reside in the Association of the property. Misuse of the pool privileges will be considered a violation of the rules.
- An ID will be issued to residents (valid proof of residency is required). Any resident who has a special circumstance may bring it to the attention of the Board of Directors for consideration. The Board will inform the member of its decision within 48 hours.
- Transfer of pool privileges to persons other than oneself will be considered a breach of contract which will result in suspension of pool privileges for one (1) week and a violation notice.
III. ENFORCEMENT OF RULES
- The Pool Manager and Lifeguards are responsible for the safe and orderly operation of the pool in the best interest of the members. Any matter requiring immediate action shall be brought to the attention of the Pool Manager or Lifeguards. The Pool Manager and Lifeguards have the authority to eject anyone, at any time, from the pool enclosure for up to 24 hours. Such action shall be reported in writing to the Board of Directors for appropriate action.
- Serious or repeated infractions of the rules shall be reported to the Board of Directors for appropriate action.
- Any member receiving three (3) violation notices during a pool season will lose pool privileges for the remainder of the season, unless otherwise directed by the Board of Directors.
- Failure to abide by these Rules or any other applicable laws will result in notification of the proper authorities.
- Any resident whose right to use the pool has been suspended may appeal that suspension to the Board of Directors.
IV. RULES FOR USE OF THE POOL
- Safety is paramount to the HOA. Persons using the pool do so at their own risk and agree to abide by the rules for use of the facility. The pool management, Community Manager, and HOA do not assume responsibility for any incident or injury in connection with such use or for any loss or damage to personal property. Residents (homeowners or tenants) are responsible for the actions of their children and guests.
- The Association is represented by pool managers and lifeguards. Conflicts shall be addressed in writing to Community Management who will make every effort to resolve issues. Decisions of the Community Management may be appealed to the Board of Directors at the next regularly scheduled meeting.
- Certified Lifeguards will be on duty at all times during which the pool is open. They have authority to use discretion to enforce rules to maintain a safe and healthy environment. The Manager or Supervisor in charge of the pool has the authority to eject anyone from the pool for rule infractions or when safety is threatened. The Manager may prohibit entry to anyone for up to one week for each violation upon agreement with the Community Manager and the HOA Board of Directors that the infractions warrant such suspension. In the case of serious violations, pool privileges may be suspended for a one (1) year period with authorization of the Board of Directors. Suspensions may be appealed to the Board of Directors.
- Children twelve (12) years of age and under must be accompanied and supervised by a parent or responsible person aged sixteen (16) or older. The parent or guardian must remain with the child AT ALL TIMES. Children ages 13-15, who have not passed the basic swim test given by the Pool Manager or Supervisor, must be accompanied by a parent or a responsible person aged sixteen (16) or older at all times.
- Unauthorized persons found inside the pool enclosure when the pool is closed will lose their privileges for the remainder of the summer and risk prosecution for trespassing.
- Birthday Parties and other social gatherings will not be permitted at the pool unless specifically authorized in writing by the Community Manager.
- Persons who have obvious infections (colds, lesions, open sores, inflamed eyes) are prohibited from using the pool facility.
- Smoking is prohibited in the pool area and bathhouse.
- Gum and chewing tobacco are prohibited in the pool area.
- Food and beverages, with the exception of plastic bottles, may be consumed only in designated areas.
- Glass containers are not permitted in the pool area or the bathhouse.
- No alcoholic beverages are permitted anywhere on the premises, including the parking area, except when approved by the Board of Directors in connection with adult social activities.
- No persons under the influence of alcohol or illegal substances shall be permitted on the property.
- No Pets (except medical assistance animals such as seeing eye dogs) shall be permitted in the pool and bathhouse areas.
- Swimmers must wear proper bathing attire. Cut-offs, dungarees, offensive T shirts or other inappropriate attire are prohibited.
- Running, pushing, wrestling, horseplay, throwing objects, yelling or any undue disturbance in or about the pool area are strictly prohibited.
- Running, pushing, wrestling, horseplay, spitting, profanity, dunking, standing or sitting on another’s shoulders are prohibited and can result in immediate ejection for the remainder of the day.
- Diaper age children must wear training pants or a cloth diaper, under rubber pants or a swim diaper, under a well-fitting swimsuit in the pool. Disposable diapers are prohibited.
- The pool may be closed at the discretion of the Pool Manager on duty in case of thunder, lightning, rain, unsanitary water conditions, or pool equipment failure.
- Water wings and all USCG approved life vests are permitted at the Lifeguard’s discretion. Kick boards are permitted at the discretion of the lifeguards. Any child using a flotation device must be accompanied and cared for by the parent or guardian at all times. Any other flotation devices used primarily to aid swimming development must be approved by the manager on duty or lifeguard prior to use.
- Nerf, inflatable, or other balls, rafts, masks, fins, or snorkels are permitted in the pool only at the discretion of the lifeguards or managers on duty. If at anytime these items become a safety hazard, management or lifeguards will ask the item to be removed. Goggles, approved by pool management staff, shall be permitted.
- Deliberate, clear and unreasonable insubordination to lifeguards results in immediate ejection for the remainder of the day.
- The pool will be closed for a minimum of six (6) hours for incidents of contamination or as specified by an authorized Pool Manager.
- Lost articles that are turned into the Pool Manager should be claimed by the owner within twenty one (21) calendar days. Failure to claim lost articles may result in disposal.
V. IDENTIFICATION

- An individual 16 years or older may be asked to show a valid photo ID with proof of residency in Hopewell’s Landing. If for any reason a resident needs a replacement pool pass (i.e. birthday during the pool season or damaged pass), the old pass must be turned in to avoid being charged a replacement fee.
- All members attending the pool must check in and check out with the lifeguards each day.
- Pool Passes registration will be valid from year to year, no need to re-register each year.
VI. GUESTS
- Association members are permitted to bring guests to the pool. Each household may be permitted a maximum of four (4) guests per day.
- Guest passes must be purchased before guests may swim in the pool. A punch pass, which will admit up to twelve (12) visits, can be purchased for $30, these will be loaded to your MokoApp account. Each use is the equivalent of $3. Residents may also contact the Management Company to purchase guest passes. Guest passes can only be redeemed when an adult member of the household is present. The member is responsible for their guests’ actions and must remain with the guests at all times. Checks made payable to Hopewell’s Landing HOA will be accepted by the lifeguards. There will be a $35 returned check fee for any returned checks. NO CASH WILL BE ACCEPTED BY THE LIFEGUARDS.
- Childcare providers, with less than a one (1) year signed contract, can have the resident/employer purchase a facility pass at the cost of $100.00 for their unlimited summer use. This pass cannot be used for residents in adjacent neighborhoods. Proof of identification and signed contract will be required. This pass must be purchased through the Management Company. Please allow 1-2 weeks for processing and mailing of this pass.
VII. INTERPRETATION OF THE RULES
- The final interpretation of any rule(s) shall be made and approved by the Board of Directors.
- The Board of Directors reserves the right to revise these rules and regulations at any time. Any revision of the rules will be posted at the pool.
